The Practice of Cross-Border Data Transfer Government Security Reviews
Many companies are undergoing an intensive Chinese government security review to gain approval to transfer personal information and company data outside of China. The process poses many challenges, including unclear evaluation standards, lack of clarity on legal definitions, and balancing disclosure requirements against company desires to protect sensitive information. To discuss the practical experience of advising companies on deciding whether to pursue a security review, drafting self-assessments, and receiving regulator feedback on applications, USCBC has invited presentations from Danny Hao, Partner at KPMG Consulting China, and Yan LUO, Partner at Covington & Burling LLP. Topics covered in the event will include:
- Answers to common questions and points of confusions regarding the security review process.
- Discussion of which government organizations are involved in the review process, and what their objectives and intentions are.
- Evaluation standards used in the security review and how to fulfil government expectations.
- Clarification of legal responsibilities and technical requirements of the security review.
This hybrid event is scheduled for Tuesday, January 17 from 9:00-10:30 AM China Time (Monday, January 16, 8:00-9:30 PM US Eastern Time) and will be hosted in person in Beijing and virtually via Zoom to accommodate members located all around the world to join this robust discussion. The in-person venue is KPMG’s Beijing office (KPMG Tower, Oriental Plaza, No.1 East Chang'an Avenue); seats are limited. In consideration of the COVID situation in Beijing, we encourage in-person attendees to wear masks during the event.
