China Shifts Trade and Investment Focus to Hainan Province

China’s announcement of a plan to establish Hainan as a free trade port (FTP) may present opportunities for companies to both sell into the market and use Hainan as a foothold to service the global market. Building upon Hainan’s establishment as a free trade zone in 2018, on June 1 this year, China’s Ministry of Justice released an extensive Overall Plan for the Construction of the Hainan Free Trade Port that aims to advance Hainan’s position in international trade, investment, and cross-border capital flows, eventually aiming for serious tariff reductions.

Following its first quarterly economic contraction in recent history, the Chinese government continues to take a relatively cautious approach to stimulating economic recovery. While economic activity picked up somewhat in April, China will likely spend the remainder of 2020 focused on stabilizing businesses and employment, but avoiding a 2008-style, credit-fueled infrastructure stimulus.

Draft Copyright Law Amendments Address Phase One Commitments, Extend Protections to All Audiovisual Works

On April 26, China’s National People’s Congress Standing Committee (NPCSC) issued draft amendments to the Copyright Law for public comment until June 13. The original law was adopted in 1990 and the current version was last amended in 2010. The State Council solicited public comments on potential revisions to the law in 2012 and 2014, but revision efforts stalled after that. If passed in the current form and fully enforced, the amendments would improve the intellectual property environment in China for all companies. The draft could face an additional round of review this year and could be passed late this year or next.

Week in Review: President Trump Announces the Revocation of Hong Kong's Special Status

Amid rising political pressure to hold China accountable, President Trump today announced the administration would begin the process of revoking Hong Kong’s special trade and economic status under US law in response to the National People’s Congress (NPC) decision to move forward with national security legislation for Hong Kong. This comes after Secretary of State Michael Pompeo earlier this week certified to Congress that Hong Kong no longer maintains a sufficient degree of autonomy to warrant special treatment from the United States, in part because of the NPC decision.

Week in Review: Hong Kong Resurfaces During NPC, White House Report Signals Rough Relationship, and Senate Passes Delisting Bill

US policymakers are preparing a strong response after China announced plans at the start of the National People’s Congress (NPC) this week to deliberate new national security legislation for Hong Kong to address subversive activity in the wake of last year’s pro-democracy protests. While President Trump hedged that we do not yet know what action China will take, he affirmed the US would address a move to undermine Hong Kong’s autonomy strongly, which may include economic penalties. The United States would likely respond to NPC approval of the proposed law by imposing targeted sanctions authorized under US laws.

Agriculture and Food Safety Update - May 20, 2020

Four months since the United States and China signed the Phase One trade deal, China has made significant progress on many of its structural commitments to increase market access and streamline regulatory processes. At the same time, first quarter US export data indicates that China has fallen behind on promised purchases of US agricultural products. This is not necessarily a representative snapshot of US-China agricultural trade due to the impacts from COVID-19, China’s March implementation of a tariff exclusion process, and crop growing seasons.
